APPLICATION OF TERMS
The general terms and conditions are based on Swiss law and apply both within Switzerland and for deliveries abroad for all business relationships resulting from the online shop (https://www.alyart.ch) these terms and conditions declared applicable. Changes and side agreements are only effective if confirmed in writing by ALYART Switzerland. The terms and conditions can be changed by ALYART Switzerland at any time and without notice. Decisive for the contractual relationship are in each case the AGB published at the time of the order. With the order, the customer accepts the present GTC.
OFFER AND CONCLUSION OF CONTRACT
Confirming and sending the order in the online shop represents an offer to ALYART Switzerland to conclude a purchase contract. Orders can also be accepted via email. The customer is bound to his offer for 30 days. The confirmation of the order by ALYART Switzerland does not constitute acceptance of the offer. A purchase contract is only concluded when the goods are sent after receipt of payment or invoice to the customer by handover to the delivery company (usually the Swiss Post). The illustrations, products, specifications and dimensional specifications shown are not binding and may deviate from the actual articles. ALYART Switzerland reserves the right not to provide services in the event of unavailability of individual items. Unavailability will be displayed by e-mail. Orders with incorrect information during registration, in particular the e-mail address and postal address, will not be considered. ALYART Switzerland is also entitled to exclude individual persons at any time from the possibility of placing an order or to refuse an order without giving reasons. There is no obligation to contract. ALYART Switzerland is entitled at any time for important reasons to withdraw from the contract.
PRICES, SHIPPING COSTS AND PAYMENT TERMS
The prices quoted in the online shop (https://www.alyart.ch) are not binding and can be changed at any time. For the price fixing the time of the order applies. Technical changes, errors and misprints are reserved. Prices are in Euro (EUR). Shipping and postage costs as well as customs or any COD charges are to be borne by the customer. Payment is by credit card (VISA, Mastercard) or by PayPal. ALYART Switzerland reserves the right to exclude individual payment methods temporarily or permanently or to exclude individual customers from certain payment methods. Invoices can not be discounted. If no payment is made within 30 days, a first reminder will be sent by post. The second reminder causes handling fees of CHF 10.-, which have to be borne by the invoice recipient. The third reminder causes handling fees of an additional CHF 20.-. If the customer causes damage to ALYART Switzerland in the course of the payment or the shipment of the goods (for example, an objection to a credit card debit or non-acceptance of a postmarked consignment), he is obliged to compensate.
DELIVERY TERMS AND DELIVERY TIME
The delivery takes place after payment of the goods. The customer has no right to reject partial deliveries. Delivery usually takes place within one to three business days after receipt of payment or in the case of cash on delivery or invoice upon receipt of order. Fixed delivery dates must be expressly confirmed in writing by ALYART Switzerland for their validity. E-mails fulfill the requirement of written form.
Use and risk are transferred to the customer when the goods are handed over to the delivery company commissioned by ALYART Switzerland. The customer must check the goods upon receipt and notify any defects in writing. If the package is damaged, the customer must notify the delivery company immediately. If the customer omits the advertisement within 7 days after receipt of the commodity, the commodity is considered free of defects and the delivery as approved.
ALYART Switzerland is committed to the care and always delivers goods in a good quality. In the case of defects in the delivered goods, ALYART Switzerland is entitled to repair or re-deliver them. If no subsequent improvement or subsequent delivery can be made, the customer may demand a change or reduction in accordance with the provisions of the Swiss Code of Obligations. Any refund will always be made in the same way as the payment was made. Excluded from the warranty are defects that ALYART Switzerland is not responsible for, such as natural wear and tear, force majeure, improper treatment, interference by the customer or third parties, excessive stress or extreme environmental influences and similar other causes.
ALYART Switzerland grants a 10-day return policy from the date of the delivery note. Returned goods must be returned in the original packaging with the delivery note and the printed return form to the address indicated on the form. The costs for the return must be borne by the customer. Only products that are absolutely intact and in perfect, unworn condition will be taken back. In particular, worn, soiled, damaged, bad-smelling articles can not be returned. Defective articles according to section 6 can also be returned within 14 days of the date of the purchase / delivery note at the customer’s own expense in the original shipping packaging with the printed return form to the address indicated on the form. ALYART Switzerland will not return the goods as defective goods, after deduction of the postage costs incurred plus any expenses incurred.
Any liability beyond the warranty claims mentioned in clause 6 shall be excluded except for intent and gross negligence for all damages resulting from the contract and any consequential damages. This limitation of liability also applies to employees, agents and vicarious agents of ALYART Switzerland. ALYART Switzerland expressly declares that it has no influence whatsoever on the design and content of the linked pages for all links contained in the online shop and websites. ALYART Switzerland expressly dissociates itself from the content of linked third-party websites and does not adopt its contents as its own. This declaration applies to all displayed links and contents of the pages to which links lead.
The goods delivered by ALYART Switzerland remain the property of ALYART Switzerland until the entire purchase price (including all surcharges) has definitely arrived at ALYART Switzerland. ALYART Switzerland reserves the right to enter a retention of title in the title retention register for the items ordered. The customer undertakes to treat the goods with care as long as they are the property of ALYART Switzerland.
To process the order, ALYART Switzerland stores personal data as far as permitted by law. These data are processed with the utmost care, taking into account the provisions on data protection. ALYART Switzerland reserves the right to use this data for verifying the correctness or credit verification. ALYART Switzerland stores personal data exclusively for order processing and advertising purposes. Customers may prohibit the processing of your data for marketing purposes at any time. Corresponding communications must be sent in writing to the following address, stating the complete contact details and customer number: ALYART Switzerland, Saatlenstrasse 18, 8051 Zürich, Switzerland. No data will be transmitted to third parties and stored there, except for the payment service providers and any vicarious agents required for validation.
All intellectual property rights in the online shop and its contents as well as in the delivered goods are owned by ALYART Switzerland or external partners. Use of legally protected intellectual property without explicit consent is prohibited.
Should one or more provisions of these terms and conditions be or become ineffective or should these terms and conditions contain gaps, the legal validity of the remaining provisions shall remain unaffected. In place of the ineffective provisions or the gap, an effective provision applies, which comes closest to the economic goal desired by the parties.
Jurisdiction is the seat of ALYART Switzerland in the canton of Zurich. ALYART Switzerland also has the right to call the court at the customer’s office. Applicable is exclusively Swiss law. The parties are required to settle by amicable settlement any dispute arising out of the performance of this contract.
ALYART Switzerland is committed to handling your customer data with the utmost care and adhering to data protection regulations. Your data will be kept strictly confidential and shared with third parties only for the processing of your order. If necessary, ALYART Switzerland will use your data to maintain customer relationships and to develop, design, and advertise offers and products as needed. As a customer, you can prohibit the processing of your data for marketing purposes at any time.
